NEW Order Waiving License Renewal Requirements

On March 4, 2020, the Governor proclaimed a State of Emergency in California as a result of the impacts of COVID-19 to make additional resources available, formalize emergency actions already underway across multiple state agencies and departments, and help the state prepare to respond to an increasing number of individuals requiring medical care and hospitalization as a result of a broader spread of COVID-19.

Pursuant to the Governor’s Executive Order N-39-20, during the State of Emergency, the Director of the California Department of Consumer Affairs may waive any statutory or regulatory renewal requirements pertaining to individuals licensed pursuant to Division 2 of the Business and Professions Code (the Code).

Accordingly, for individuals whose active licenses expire between July 1, 2020, and August 31, 2020, the Director temporarily waives:

1. any statutory or regulatory requirement that individuals renewing a license pursuant to Division 2 of the Code take and pass an examination in order to renew a license; and,

2. any statutory or regulatory requirement that an individual renewing a license pursuant to Division 2 of the Code complete, or demonstrate compliance with, any continuing education requirements in order to renew a license. These temporary waivers do not apply to any continuing education, training, or examination required pursuant to a disciplinary order against a license.

Licensees must satisfy any waived renewal requirements within six months of this order, unless further extended.

These temporary waivers do not relieve such individuals from timely complying with any other renewal requirements, including completing and submitting the required renewal forms to the governing licensing agency.

Hello Board of Chiropractic Examiners' Subscribers,

California continues to battle two of the largest fires in the state’s history, and nearly 600 new fires have been caused by dry lightning strikes in the last week. Yesterday, a Presidential Major Disaster Declaration was approved for seven Northern California counties, triggering the availability of federal relief.

Governor Gavin Newsom yesterday announced that the White House has approved California’s request for a Presidential Major Disaster Declaration to bolster the state’s emergency response to wildfires burning in Northern California and to support impacted residents in Lake, Napa, San Mateo, Santa Cruz, Solano, Sonoma and Yolo Counties.

A Presidential Major Disaster Declaration helps people in those counties through eligibility for support including crisis counseling, housing and unemployment assistance and legal services.

People who have sustained losses in the designated areas can now begin applying for assistance by registering with the Federal Emergency Management Agency (FEMA) online at https://www.disasterassistance.gov or by calling 800-621-FEMA (3362) or 800-462-7585 TTY. FEMA is encouraging people to register online whenever possible.

NEW Order Waiving License Renewal Requirements

On March 30, 2020 Governor Newsom issued Executive Order N-39-20, authorizing the Director of the Department of Consumer Affairs (DCA) to waive any of the professional licensing requirements relating to healing arts licensees in Division 2 of the Business and Professions Code, and any accompanying regulations. This includes, but is not limited to, the examination, education, experience, and training requirements necessary to obtain and maintain licensure, and requirements governing the practice and permissible activities for licensees.

There is currently one waiver affecting all licensees from March, 2020 through October, 2020.

DCA Waiver DCA-20-53: March - October licensees are able to postpone continuing education requirements for their license renewal.  They have until February 28, 2021 to complete 24 hours of continuing education credit; 12 hours as in-person credit and 12 hours as distance learning credit.  Licensees must renew their license during their expiration month to maintain an active license.

A full list of waivers will be placed on the DCA website as they are approved.  https://www.dca.ca.gov/licensees/dca_waivers.shtml

The following waivers  have been rescinded: DCA Waiver DCA-20-01 and DCA Waiver DCA-20-27.
